Family Dispute Resolution Practitioners are bound by the Family Law Act 1975 (Cth) in relation to confidentiality and disclosure of any communication made in mediation. 

At the Centre for Mediation, documentation prepared for mediation, as well as any discussions that occur during the process (including any settlement proposals or compromises made) are treated with absolute confidentiality. We expect that you will treat the information from your mediation in the same way.

Information about your mediation (including settlement offers) cannot be used if you proceed to Court. However, it is not unusual for the Court, when making ‘consent orders’ in relation to your child/children, to take into account the most recent Parenting Agreement reached through mediation if the Court is satisfied that the terms of the Parenting Agreement is in the best interests of your child/children.
